Capra Audio Comfort Strap Limited Warranty

This Limited Warranty applies to the Capra Audio Comfort Strap (the "Product") purchased directly from Capra Audio or an authorized Capra Audio reseller.

1. Warranty Period

Capra Audio warrants the Product against defects in materials and workmanship for a period of one (1) year from the date of original retail purchase (the "Warranty Period"). A valid proof of purchase is required for all warranty claims.

2. What This Warranty Covers

This Limited Warranty covers only manufacturing defects in materials and workmanship that arise during normal use of the Product within the Warranty Period. If a defect covered by this warranty arises, Capra Audio will, at its sole discretion, either:

  • Repair the Product using new or refurbished parts.

  • Replace the Product with a new or refurbished Product of equivalent performance and reliability.

  • Refund the original purchase price of the Product.

3. What This Warranty Does Not Cover

This Limited Warranty does not cover:

  • Normal wear and tear, including scratches, scuffs, discoloration, or stretching that occurs over time.

  • Damage caused by misuse, abuse, neglect, accident, improper installation, or failure to follow instructions provided by Capra Audio.

  • Damage caused by unauthorized modifications, alterations, or repairs not performed by Capra Audio or an authorized service provider.

  • Damage caused by acts of God, such as lightning, flood, fire, earthquake, or other external causes.

  • Damage caused by exposure to extreme temperatures, humidity, or other environmental conditions.

  • Damage to any non-Capra Audio product, even if packaged or sold with the Product.

  • Products purchased from unauthorized resellers.

  • Products without a valid proof of purchase.

4. How to Obtain Warranty Service

To obtain warranty service, you must:

  1. Contact Capra Audio customer support at support@capraaudio.com within the Warranty Period.

  2. Provide a clear description of the defect.

  3. Present the original proof of purchase, such as a sales receipt or invoice, which clearly shows the date of purchase and the product name.

  4. If requested by Capra Audio, return the Product, securely packaged and with postage prepaid, to the address provided by Capra Audio customer support.

Capra Audio reserves the right to inspect the Product to determine if the defect is covered by this Limited Warranty.

5. Remedies

If a valid claim is received within the Warranty Period, Capra Audio will, at its option, repair or replace the Product, or refund the purchase price. Any repaired or replacement Product will be warranted for the remainder of the original Warranty Period or ninety (90) days from the date of delivery of the repaired or replacement Product, whichever is longer.

6. Limitation of Liability

EXCEPT AS PROVIDED IN THIS WARRANTY AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPRA AUDIO IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF REVENUE, LOSS OF ACTUAL OR ANTICIPATED PROFITS (INCLUDING LOSS OF PROFITS ON CONTRACTS), LOSS OF THE USE OF MONEY, LOSS OF ANTICIPATED SAVINGS, LOSS OF BUSINESS, LOSS OF OPPORTUNITY, LOSS OF GOODWILL, LOSS OF REPUTATION, OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE WHATSOEVER CAUSED, INCLUDING THE REPLACEMENT OF EQUIPMENT AND PROPERTY, ANY COSTS OF RECOVERING, PROGRAMMING, OR REPRODUCING ANY PROGRAM OR DATA STORED IN OR USED WITH THE CAPRA AUDIO PRODUCT, AND ANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF DATA STORED ON THE PRODUCT.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

7. Governing Law

This Limited Warranty shall be governed by and construed in accordance with the laws of [State/Country where Capra Audio is registered, e.g., the State of West Virginia, USA], without regard to its conflict of laws principles.
